New Echota is one of the most significant NDN sites in the nation and was where the tragic “Trail of Tears” officially began.. Gold would be found on Cherokee land and lotteries were distributed to European Settlers without the Cherokees consent or signing any treaties.. Chief John Ross would win a Supreme Court case in 1832 Worcester v Georgia held (5–1) that the states did not have the right to impose regulations on Native American land. President Andrew Jackson refused to enforce the ruling. Jackson would negotiate the New Treaty of Echota in 1835.
